FACTS:                    

The large team has removed the brokerage name from its marketing and advertising materials.  The team leader claims that based on a new statute, the brokerage firm no longer needs to be identified on the team’s marketing and advertising materials. 

ISSUE:                      

Is the brokerage firm’s name still required to be included in team marketing and advertising materials?

ANSWER:                

Yes.

DISCUSSION:         

In 2022, there were certain statutory changes made to team arrangements dealing with compensation.  However, those changes in the statutes did not affect any advertising requirements.  Accordingly, the name of the brokerage must be identified in all advertising and marketing materials in a “clear and prominent manner.”  A.A.C. R4-28-502(E).
