FACTS:

The buyer and seller entered into the Arizona REALTOR® Residential Resale Contract.  The buyer selected her home inspector and is in the process of scheduling an appointment for the inspection.  The seller communicated that he would not allow that home inspector on the property.  In fact, the seller mandated that the buyer use a home inspector specified by the seller.

ISSUE:

May the seller select the home inspector on behalf of buyer? 

ANSWER: 

No.

DISCUSSION: 

The buyer has a right to conduct whatever reasonable inspections she deems appropriate pursuant to the terms of the contract.  The seller is not contractually able to mandate that a specific home inspector be used.  If the seller wanted to specify the home inspector (which is not an advisable practice), he should have made that desire clear in the purchase contract before signing.
