Mediation Agreement

  • The undersigned agree to submit this dispute to mediation in accordance with the mediation guidelines as set forth in the Code of Ethics and Arbitration Manual of the NATIONAL ASSOCIATION OF REALTORS® (NAR) and Arizona REALTORS® policies and procedures.

    The Parties further understand and agree as follows:

    No aspect of the mediation conference shall be relied upon or introduced as evidence in any ethics hearing, arbitration, judicial, or other proceeding. The parties acknowledge that the mediation proceeding will not be recorded. If the parties agree to a settlement of the dispute, and the settlement is reduced to writing and signed by all parties, the agreement shall be binding and as such, subject to judicial enforcement, and the non-complying party agrees to reimburse the other party for court costs and reasonable attorney’s fees. If a party intends to have legal counsel present at the mediation conference, that party shall advise Arizona REALTORS® staff and notice the other parties, at least ten (10) days prior to the mediation conference. The parties acknowledge that neither Arizona REALTORS® staff nor the mediator, are providing legal advice or representation.

  • By my signature on this Agreement to Mediate, I acknowledge my rights, and agree to the terms of the mediation procedures as stated above. I hereby affirm that I have the authority to enter into and sign a binding written agreement to settle this complaint.
