Arizona Association of REALTORS® mediation is provided as a voluntary option to resolve ethics disputes.

Unlike the hearing process, with mediation the parties are in charge of their decisions. Mediation agreements can encompass everything a hearing panel could decide and more. With the agreement of all parties to participate in an ethics mediation, a third-party REALTOR® will help the parties to discuss their dispute and formulate a mutually agreed upon settlement.

The following individuals have agreed to serve the Arizona Association of REALTORS® (“Arizona REALTORS®”) as Mediation Officers.

As a party to mediation, you have the right to challenge any mediator that you believe would not be acceptable to serve as the Mediation Officer for your mediation conference. If you are not indicating a preference, you are agreeing to accept any available Arizona REALTOR® mediator.

The undersigned agree to submit this dispute to mediation in accordance with the mediation guidelines as set forth in the Code of Ethics and Arbitration Manual of the NATIONAL ASSOCIATION OF REALTORS® (NAR) and Arizona REALTORS® policies and procedures.

The Parties further understand and agree as follows:

No aspect of the mediation conference shall be relied upon or introduced as evidence in any ethics hearing, arbitration, judicial, or other proceeding. The parties acknowledge that the mediation proceeding will not be recorded. If the parties agree to a settlement of the dispute, and the settlement is reduced to writing and signed by all parties, the agreement shall be binding and as such, subject to judicial enforcement, and the non-complying party agrees to reimburse the other party for court costs and reasonable attorney’s fees. If a party intends to have legal counsel present at the mediation conference, that party shall advise Arizona REALTORS® staff and notice the other parties, at least ten (10) days prior to the mediation conference. The parties acknowledge that neither Arizona REALTORS® staff nor the mediator, are providing legal advice or representation.
