FACTS: Buyer and seller entered into an Arizona REALTORS® Residential Resale Real Estate Purchase Contract (“Contract”). During the 10-day inspection period, buyer scheduled a licensed roofer to inspect the roof, a licensed HVAC technician to inspect the air conditioner, and a home inspector.

The listing agent advised buyer’s agent that only one inspector could go to the property during the inspection period.

ISSUE: During the inspection period, is buyer only limited to one inspector?

ANSWER: No.

DISCUSSION:

Pursuant to section 6m of the Contract, seller must make the property available for all inspections. Further, nothing in the Contract limits the buyer’s right to conduct all inspections he deems necessary during his inspection period.

Therefore, upon reasonable notice, seller must allow buyer’s inspectors entrance into the property.
