With Full Disclosure and a Written Agreement, a Licensee May Host an Open House for a Listing of Another Brokerage Firm
FACTS:
The broker owns a small brokerage with just herself and one licensed partner, her spouse. The broker would like to enlist another brokerage to host open houses on the broker’s listings while she is on vacation for short periods.
ISSUE:
Can a licensee from another brokerage host an open house for the broker’s listings while the broker is out of town?
ANSWER:
See discussion.
DISCUSSION:
A licensee from another brokerage may host an open house provided all parties agree to the arrangement in writing. The licensee hosting the open house must make it clear to all potential buyers that he/she is not representing the seller and must clearly identify their company through signage, business cards distributed and all advertising.
