| Recent legislation (HB 2824) establishes a Condominium and Planned Community Hearing Office for conducting hearings brought by a Homeowner’s Association (HOA), condo associations or members. An owner or association may petition the department for a hearing concerning violations of condominium documents, planned community documents or violations of the statutes that regulate condominiums or planned communities. The department does not have jurisdiction over disputes between owners to which the association is not a party or disputes between an owner and any other organization engaged in the business of designing, constructing or selling a condo or improvements within a planned community. Decisions by an administrative law judge in an action regarding a condo or planned community are the final administrative decision and are not subject to re-hearing.
