2008 NON-RENEWALS ON IN-ACTIVE STATUS…Per AAR Bylaws, any 2007 member on which no 2008 renewal dues are received will be placed on inactive status effect April 30, 2008. FREE FORECLOSURE PREVENTION WORKSHOP…The BBB Mortgage Advisory Council (of which AAR is a member) is promoting this free half day Foreclosure Prevention Workshop on Saturday, May 10, at Phoenix City Hall. The Mayor and Congressman Pastor will be there. The sponsors are the Federal Home Loan Bank of San Francisco, the AZ Foreclosure Prevention Task Force and the AZ Housing Counseling Collaborative. Individual counseling sessions will be available after the remarks and panel discussion on a first-come, first-served basis. www.fhlbsf.com/. FOR SALE SIGNS IN HOAs…As a result of SB 1062 (A.R.S. §33-1261 and §33-1808), a homeowner living in a planned community or a condominium HOA formed on or after January 1, 1986, and those formed before that date that don’t conflict with the statutes are permitted to display an industry-standard size for sale sign on the owner’s property, even if such signs are prohibited in the HOA governing documents. Some HOAs have taken the position that the statute is not enforceable or that it allows the HOA to regulate color, content or location for the signs. A member or seller who would like to challenge an HOA taking such a position should be advised to try to resolve the issue with the HOA informally, consult legal counsel and/or file a lawsuit for injunctive relief and damages or file a complaint with the newly formed HOA dispute resolution department; see www.dbfs.state.az.us/OA/Downloads/HOA%20Package04012007.pdf. AAR cannot enforce the law, but has a Legal Action Fund that upon application and executive committee approval, may be available to assist in any such litigation.
